Investigations

With the Acas Code of Practice Disciplinary and Grievance Procedures, stressing the need for thorough and prompt investigations into alleged misconduct, poor performance and complaints about various work-related matters, including bullying and harassment, employers are now faced with a rising number situations where an investigation into the facts needs to take place before any action is decided upon.

Investigations need careful planning, including identifying the issues, drawing up a terms of reference and putting together an investigation plan. This needs to be followed by a thorough, timely, objective, transparent and fair investigation, concluding with an analysis of the evidence, making findings of fact and deciding whether there is a case to answer in an impartial and objective way.

We advise clients on the investigation process and the legal issues which need to be considered. We also run in-house master classes on conducting investigations or we can conduct the investigation for you, managing the whole process, including producing a comprehensive report, attending grievance and disciplinary hearings and providing feedback on issues arising from the investigation.

Our track record includes carrying out investigations into alleged misappropriation of funds by administrative staff and misconduct by a high ranking union official at a large London Council and an investigation into allegations of stress, harassment and bullying for a high profile media company.
