Information and consultation are at the heart of good employee relations. Information about business performance, working arrangements and terms and conditions plays an integral part in employee engagement.
Consultation, through a meaningful exchange of views, allows for informed decision making, and is a mandatory legal requirement in a number of situations, such as large scale redundancies. Consultation also plays an integral part in operating works councils at national or local level, European Works Councils and workforce agreements, such as under the Working Time Regulations 1998, Parental Leave Regulations, and so on. We have advised clients on:
• individual consultation in redundancy and contract
variation exercises
• the election of employee representatives
• information and collective consultation in redundancy,
business re-organisation and TUPE situations
• establishing local works councils under the ICE Regulations
2004 and cross-border European Works Councils
• workforce agreements relating to working time, fixed-term
employees and parental leave
